Permanent Residency (Green Card) Guidelines
|
Certain categories of foreign immigrants are eligible to become
permanent residents, also known as 'green card holders'. One of
these categories is the health care worker employed in the United
States. The basis for the eligibility is the employment. In order
to apply it is necessary that the employer agrees to sponsor the
employee for the 'green card'. The ease of applying to become a
permanent resident can vary depending on the profession of the applicant.
Certain health care professions, especially the registered nurse,
are given easier application procedures for filing, making it easier
on the employer and relatively quick for the applicant. In USA the
Immigration and Naturalization Services
(INS) issue Green Card. Make sure all information in all forms consistent
otherwise we may face difficulties in processing application hence
extra delays.

The residency alien 'green card' application is a two-step process.
The first stage requires an employer to sponsor the application
and the initial petition is filed. Upon approval, the second part
of the petition is filed and once all documents are received and
approved, the local American Consulate is notified and an interview
will be granted.
If already residing in the US, 'employment authorization' can be
applied for and the nurse is able to work while waiting for the
approval of the permanent residency status.
Immigration to the United States is a complicated and fact specific
procedure. The background, goals and needs of each person and
family wishing to immigrate to the United States makes it necessary
to tailor each applicant's petition. Due to the uniqueness of each
application the costs and filing fees associated with immigrating
may vary from applicant to applicant.
Before your permanent residency is granted there is a new law passed
by congress, that all health care workers must complete a Visa Screen
with ICHP, located in Philadelphia, PA. This is mandatory and each
individual pays the fees to ICHP.

Third

Center will notify the American Consulate in your home country.
Once the US
Consulate has received approval an interview time will be scheduled.
All documentation
including fingerprints, medical, pictures, employment letter etc. must
be current at time of interview. Do not get medical of fingerprints
until the American Consulate instructs you to do so.
All family
members should attend the interview.
One of the main benefits in applying for permanent residency is that
spouses and children of the main applicant are also eligible to become
'green card holders'. The spouse and/or child can also obtain employment
authorization and this can be obtained while the 'green card' applicant
is in process (for those already in the US) and is usually granted within
three to six months.
After holding a 'green card' for five years, the holder is eligible to
apply for citizenship. Additionally, the 'green card holder' can work
for any employer (be sure to fulfill your initial obligation to your sponsoring
employer) and there is no limitation on the number of employers you can
work for.
Cost of a Green Card
Cost of the Green Card to you varies from FREE to US $1,750. Some hospitals
offer to pay in full the cost and some subsidies up to US $750. Others
do not pay anything; in this case it is your responsibility to cover this
cost. Please refer to schedule attached for such information regarding
relevant hospital policy.
